<h1>IUPUI DataWorks Deposit Agreement</h1>

<p>The University must be granted permission to distribute and preserve
all works placed in the IUPUI DataWorks repository. The
creator/original rights owner retains all intellectual property rights
on all works. When creators submit content to the IUPUI DataWorks
repository, they agree to the following:</p>

<p>By depositing this Content ("Content") in the IUPUI DataWorks
repository ("DataWorks"), I agree that I am solely responsible for any
consequences of uploading this Content to DataWorks and making it
publicly available, and I represent and warrant that:</p>

<ol>
<li>
        I am either the sole creator and the owner of the copyrights
        and all other rights in the Content; or, without obtaining
        another's permission, I have the right to deposit the Content in
        an archive such as DataWorks.
</li>

<ol>
<li>
           In preparing the data for public archiving and
	   distribution, I removed any confidential or sensitive
	   information, student education records protected under FERPA,
	   and all information that personally identifies any individual
	   or that contains any information classified as highly
	   sensitive under state or federal law, or IUPUI policy. For
	   these purposes, highly sensitive data currently includes
	   personal information that can lead to identity theft if
	   exposed and health information that reveals an individual's
	   health condition and/or history of health services use.

<li>
           I have considered whether other researchers have rights to
           manage the release of this Content, for example others
           involved with the grant, research activity, or laboratory,
           whether at IUPUI or at another institution. If the answer
           to this question was yes, I obtained their permission to
           deposit the Content in IUPUI DataWorks.

</ol>

<li>
        To the extent that any portions of the Content are not my own
        creation, they are used with the rights holder(s)' express
        permission or as permitted by law. Additionally, the Content does
        not infringe the copyrights or other intellectual property rights
        of another, nor does the Content violate any laws or another's
        rights of privacy or publicity.
</li>

<li>
        The Content contains no restricted, private, confidential, or
        otherwise protected data or information that should not be
        publicly shared.
</li>
</ol>

<p>
     I understand that the University will do its best to provide
     perpetual access to my Content. In order to support these
     efforts, I grant the Indiana University Board of Trustees,
     through DataWorks, the following non-exclusive, perpetual,
     royalty-free, world-wide rights and licenses:
</p>

<ol>
<li>
        to access, reproduce, distribute and publicly display the
        Content, in whole or in part, in order to secure, preserve and
        make it publicly available, and;
</li>
<li>
        to make derivative works based upon the Content in order to
        migrate the Content to other media or formats, or to preserve its
        public access.
</li>
</ol>
<p>
These terms do not transfer ownership of the intellectual property
rights in the Content. These terms only grant to the University the
limited license outlined above.
</p>

You agree to hold IUPUI harmless in the event of any violation. IF THE
SUBMISSION IS BASED UPON WORK THAT HAS BEEN SPONSORED OR SUPPORTED BY
AN AGENCY OR ORGANIZATION OTHER THAN INDIANA UNIVERSITY AND PURDUE
UNIVERSITY, YOU REPRESENT THAT YOU HAVE FULFILLED ANY RIGHT OF REVIEW
OR OTHER OBLIGATIONS REQUIRED BY SUCH CONTRACT OR AGREEMENT. IUPUI
will clearly identify your names(s) as author(s) or owner(s) of the
submission, and will not make any alteration, other than as allowed by
this license, to your submission.
